Driver or Transportation Agency Terms & Conditions

This Independent driver or Transportation Agency or Contractor (the "Agreement") executed on this day of first time signup, by and between imTransporter brand name registered under legal entity Kalibroida Technology Solutions Pvt. Ltd., with address at Suratwala Mark Plazzo, 808, Survey No. 27/1,28/1, Hinjawadi Infotech Park, Hinjawadi, Phase 1 Pune Maharashtra 411057, represented by imTransporter (hereinafter known as "Company" or “us”); and signed up on imTransporterdriver mobile application as a driver with otp confirmation (hereinafter known as “Independent driver” or “transportation agency” or "Contractor");

Background

Whereas Company desires to engage the Independent driver or Transportation Agency or Contractor Agreement and the Independent driver or Transportation Agency or Contractor desires to provide service to the Company in providing transportation services for the Company cargo delivery or goods transport for consignment request generated by customer on imTransporter application or on web portal for schedule period provided for by the Company, subject to the terms and conditions under this Agreement;

Now therefore in consideration of the premises and of the terms, conditions and agreements herein contained, the parties hereby agree as follows:

Services

Independent driver or Transportation Agency or Contractor shall provide goods transportation services for delivery, or carriage transport from points of pick-up designated by the Company to specific points of destination that shall be stated by the Company on a periodic basis, in accordance with the terms and conditions of this Agreement.

Terms of Services

The Independent driver or transportation agency or contractor agrees and accepts that the use of the vehicle is at the sole risk of the Independent driver or transportation agency or contractor and further acknowledges that the imTransporter is just a aggregater and disclaims all representations and warranties of any kind, whether express or implied.

The Independent driver or transportation agency or contractor shall ensure that they will not indulge in any of the following activities while availing the service:

Soiling or damaging the goods while transportation
Misusing, soiling or damaging any of the goods.
Independent driver or transportation agency or contractor shall not break any Traffic/RTO/City Police and/or government rules for any purpose. In case any of the customer demand to do the same the Independent driver or transportation agency or contractor has the right to refuse such a request. The Independent driver or transportation agency or contractor also has the right to refuse such a pick-up.
Independent driver or transportation agency or contractor ensures that truck should not be overload with the consignment than the allowed limit.
The company is hereby authorized to use the location based information provided by any of the telecommunication companies when the Independent driver or transportation agency or contractor uses the mobile phone to agreed to transport the goods through i'm Transporter mobile or web platform. The location based information will be used only to facilitate and improve the probability of locating a vehicle for the Customer.
The Company shall be entitled to disclose to all companies within its group, or any government body as so required by the Applicable Law or by directive or request from any government body, the particulars of the Independent driver or transportation agency or contractor in the possession of Company in any way as Company, in its absolute discretion, deems fit or if it considers it in its interests to do so. The Company shall be entitled at any time without giving any reason to terminate the booking of the vehicle done by the Customer. User(s) shall indemnify im Transporter with respect to any expenses incurred with respect to such booking.
Independent driver or Transportation Agency will be responsible in case of lost items during the transit, It is the responsibility of respective Independent driver or Transportation agency to check and confirm with customer that each product or goods and packing while loading in vehicle and unloading from vehicle. Company will try to locate the items on a "best-effort" basis but is not responsible for the same in case of loss or damage or theft or misappropriation to / of the same. imTransporter aggregates the vehicles for the purposes of providing Services. In the event of loss of any item, User(s) shall not have any right to withhold the payment to be made to imTransporter. Further, in the event any payments from the User to imTransporter are pending for the period prescribed by imTransporter in its respective invoice / statement, imTransporter reserves the right, in accordance with the Applicable Law, to exercise particular lien over the consignment till full payment is made to imTransporter for the Services. Additionally, User(s) will be liable to indemnify imTransporter against any loss, damage or expenses incurred by it due to the custody of the consignment during this period.
Any complaint in respect of the Services or the behavior of user or customer, can be inform to imTransporter in writing within 24 hours of using the vehicles or Services of the Company. The Company shall not be liable for any conduct of the users or customer However, the Company encourages you to notify it, of any complaints that you may have against the users that you may have chosen using the Company's Services.
The Company shall be entitled to add to, vary or amend any or all these terms and conditions at any time and the Independent driver or transportation agency or contractor shall be bound by such addition, variation or amendment once such addition, variation or amendment are incorporated into these terms and conditions at Company's Independent driver's or vendor imTransporter mobile application or at web portal www.imtransporter.com on the date that Company may indicate that such addition, variation or amendment is to come into effect.
All the calls made to the Company's call centre are recorded by the Company for quality and training purposes. In the event you place a query on our app/website including any query with respect to our Services, applicable fees or Terms of Service, you hereby expressly agree to consent to receive our responses, whether by way of telephonic calls or electronic mail, to such query and all related information with respect to our Services. For removal of doubts, related information shall include without limitation any marketing and/or commercial information. You understand, agree and acknowledge that such information shall in no event, qualify as unsolicited commercial communication under the Telecom Unsolicited Commercial Communications Regulations, 2007 and/or due to disclosure of such information, our telephone numbers shall not qualify to be registered under the 'National Do Not Call Register' or the 'Private Do Not Call Register' in accordance with the Telecom Unsolicited Commercial Communications Regulations, 2007 or any other Applicable Law.
Once the Independent driver or transportation agency or contractor accepted the goods transport request generated by customer by using imTransporter application or web portal then on cancellation of same transport request by Independent driver or transportation agency or contractor will incur a cancellation fee of INR. 30/- (Indian Rupees Thirty). Canceling five bookings in a day after transportation request accepted will temporarily suspend your account for 48 hours and you will not receive any transportation request in 48 hours.

This Agreement is not exclusive between the Independent driver or Transportation Agency or Contractor and the Company and the latter may hire other service providers having the same or similar service provided by Independent driver or Transportation Agency or Contractor. The schedule may change on a periodic basis;

The Independent driver or Transportation Agency or Contractor shall assure that the vehicle shall always be made ready and available for the Company in accordance with the schedule, and shall further undertake that should there be any problem with any of the vehicles incapable for transport, Company shall be notified beforehand.

Contract Period

This Agreement will is valid for every time driver logged in to imtransporterdriver android or ios application and ends on everytime driver logged out on completion of service or successful delivery.

Independent driver or Transportation Agency or Contractor Expenses

Company shall not shoulder Independent driver or Transportation Agency or Contractor's work-related expenses

Brokerage

In the event that Independent driver or Transportation Agency or Contractor is unable to perform the duties as required of him with the terms and conditions of this Agreement, Independent driver or Transportation Agency or Contractor shall promptly notify the Company of such absence and shall broker the services to another carrier or Independent driver or Transportation Agency or Contractor whose candidature needs to approved firs as authorized service provider over imTransporter Driver’s Mobile application or on web portal, subject to the same terms and conditions as with the Independent driver or Transportation Agency or Contractor and Company in this Agreement.

For any fault or damage caused by the replacement party, the Independent driver or Transportation Agency or Contractor shall be held liable for any damage, loss, or delay.

Contract Amount

The Parties agree that the Independent driver or Transportation Agency or Contractor shall have a/an Amount based on the trip completed provided by imTransporter application or web portal of inclusive of taxes, paid every week.

Independent driver or Transportation Agency or Contractor Responsibilities

In providing the Services, Independent driver or Transportation Agency or Contractor shall:

Provide properly licensed and qualified professional drivers who are able to understand and comply with instructions given to them, who understand mobile phone functionality well.
Responsible in exercising with extraordinary diligence in the vigilance over the goods and safety of goods transported by them according to all the circumstances of each case assigned to them;
Ensure that in the carriage of goods or transport of goods , drivers shall present and conduct themselves professionally in an appropriate and polite manner at all times;
Secure the cargo free from any claim, lien, encumbrance, charges or any interference during transport;
Secure all the necessary legal and administrative documents required such as permits and licenses required for the performance of the Services.

Safety Regulation

Independent driver or Transportation Agency or Contractor shall at all times:

Be responsible and professional at all times in complying with the required standards set forth for the carriage;
Take the necessary precautions during transport and shall at all times keep in mind their responsibilities;
Comply with all applicable regulations prescribed by law, regulation, or governmental authority;
Provide their drivers the necessary knowledge, training, and supervision necessary to ensure the health and safety of those individuals while performing the services;
Have the discretion to refuse or modify any loads of Cargo for safety or regulatory reasons. However, such refusal must notify the Compan as early as possible.

Warranties and Representation

Independent driver or Transportation Agency or Contractor hereby represents and warrants that it has all the necessary equipment and personnel required to perform the duties and responsibilities needed by the Company in accordance with the terms and conditions of this Agreement.

Applicable Law has been complied with by you.

Circumstances beyond our control such as (but not limited to):
Your acts or omissions or those of third parties such as: You being in breach of (or any other party claiming an interest in the consignment causing you to breach) your obligations under these terms and conditions.
The contents of the consignment consisting of any article that is a prohibited item / Dangerous Goods / Valuables even though we may have accepted the consignment by mistake or you have willingly delivered without notifying / informing / declaring to us.

Confidentiality

Confidential information as contemplated in this Agreement shall refer to any information relating to the above-named Company referring to any proprietary information, personal, or in any case, information for which is not disclosed to the public or reasonably considered common knowledge. Independent driver or Transportation Agency or Contractor shall not disclose to any third party any confidential information belonging to the Company which Independent driver or Transportation Agency or Contractor may have acquired incidentally during the performance of this Agreement or in trust by the Company to Independent driver or Transportation Agency or Contractor.

Insurance

Independent driver or Transportation Agency or Contractor shall obtain their own insurance policy and maintain during the term of this Agreement the following insurance coverage:

All risk Cargo Insurance.
Motor Vehicle Liability insurance with an insurance liability amounting not less than INR 1,00.000 per occurrence combined single limit for bodily injury, including death, and property damage, covering all owned and not owned motor vehicles;
Commercial General Liability insurance with sudden and accidental pollution coverage amounting to not less than INR 2,00,000per occurrence with the Company as the insured and as certificate holder. This liability insurance shall include premises and operations liability, contractual liability, employer’s liability, owner’s and Independent driver or Transportation Agency or Contractor’s protective liability, cross liability or severability of interests liability, personal and advertising injury liability, and loss of use of property coverage. Keeping active insurance and buying insurance is solely “Independent driver” or “transportation agency” or "Contractor" Responsibility.

No Employer-Employee Relationship

The Parties agree that this Agreement does not constitute an employer-employee relationship. Parties likewise agree that this Agreement does not constitute a partnership or joint venture but is exclusively a contract for service.

Company is not required to pay or make contributions to Independent driver or Transportation Agency or Contractor's provident fund or ESIC or any employee insurance or social security, taxes, unemployment or workers' compensation, insurance premiums, or any other benefits received by persons under the Company's employ.

Your Obligation

•You warrant, undertake and guarantee to us: Independent driver or transportation agency or contractor must have notice the contents of the consignment (including but not limited to weight and number of items) have been properly described on consignment note shared on dirver's mobile application and its the responsibility of Independent driver or transportation agency or contractor that items/goods mentioned in consignment note and the items/goods given in actual for transport should same and the Consignment Note is complete in all respects and the documents as required for the transporting the consignment including invoice, permits are enclosed with the Consignment Note.

•That the contents of the Consignment are not Prohibited Items and/or are not restricted by the applicable regulations and that customer supplied to Independent driver or transportation agency or contractor any Dangerous Goods declaration that is needed, properly and accurately in accordance with Applicable Law and neither you nor the consignee is a person or organization with whom we or you may not legally trade under Applicable Law.

•That all statements and information and documents provided by you relating to the Consignment will be true and correct and you acknowledge that in the event that you make untrue or fraudulent statement about the Consignment or any of its contents, you would risk a civil claim and/or criminal prosecution the penalties for which may include forfeiture and sale. You agree to indemnify us and hold us harmless from any claims that may be brought against us or our agents arising from the information provided by you.

•You are authorized to deliver the goods at the address mentioned on the Consignment Note and without prejudice to the foregoing it is expressly agreed that we shall be conclusively presumed to have delivered the goods in accordance with this contract. We need confirmation from Independent driver or transpiration agency for delivery made on imtrasporter application no-response within 24 hours of expected delivery time would be considered as violation of rules You need to ensure the correct weight of the consignment.

•You understand, agree and acknowledge that the Services are not suitable for transportation of valuables like cash, gold, silver, diamond, precious stones, jewels or jewellery, expensive luxury items etc. (“Valuables”). If you handover / load the vehicles with Valuables for transportation, any loss / damage / theft / misappropriation to / of the consignment shall be at your risk and not ours, for the reasons mentioned earlier and without prejudice, we shall not only have the right to explicitly and specifically disclaim any liability and/or responsibility arising/accruing from the damage / loss / theft / misappropriation to/of the consignment or any contents of the consignment, but also the right to claim indemnification from you where we have suffered loss of reputation / goodwill due to your actions of breaching our terms of service.

•You agree to indemnify us and hold us harmless from any liabilities we may suffer or any costs, damages or expenses, including legal costs, we incur either to you or to anyone else arising out of you being in breach of any of these warranties, representations and guarantees, even if we inadvertently accept a consignment that contravenes any of your obligations.

•You certify that all statements and information you provide relating to the transportation of the consignment or vehicle information or all required valid documents of vehicle or Independent driver will be true and correct.

•You acknowledge that in the event that you make untrue or fraudulent statements about the consignment or any of its contents you risk a civil claim and/or criminal prosecution the penalties for which include forfeiture.

•To the extent that we may voluntarily assist you in completing the required customs and other formalities such assistance will be rendered at your sole risk. You agree to indemnify us and hold us harmless from any claims that may be brought against us arising from the information you provide to us pertaining to vehicle and respective Independent driver and any costs we will incur regarding this, and pay any administration fee we may charge you for providing the Services described in this condition.

•The customer agrees and acknowledges that the use of the Services offered by Company is at the sole risk of the customer and that Company disclaims all representations and warranties of any kind, whether express or implied as to condition, suitability, quality, merchantability and fitness for any purposes are excluded to the fullest extent permitted by Applicable Law. Without prejudice to the above, the Company makes no representation or warranties with respect to the Services meeting the Independent driver or transportation agency or contractor's requirements.

•The Services will be uninterrupted, timely, secure, or error-free.

•Any responsibility or liability for any loss or damage, howsoever caused or suffered by the Independent driver or transportation agency or contractor arising out of the use of Services offered by Company or due to the failure of Company to provide Services to the Independent driver or transportation agency or contractor for any reason whatsoever including but not limited to the Independent driver or transportation agency or contractor 's non-compliance with the Services' recorded voice instructions, malfunction, partial or total failure of any network terminal, data processing system, computer tele-transmission or telecommunications system or other circumstances whether or not beyond the control of Company or any person or any organization involved in the above mentioned systems. Any liability for any damages of any kind arising from the use of the Service offered by the Company, including, but not limited to direct, indirect, incidental, punitive, and consequential damages. Any additional or extra charges for far off locations & toll charges as well. Any additional or extra charges for far off locations & toll charges as well.

•You warrant, undertake and guarantee to us: Independent driver or transportation agency or contractor that you will encourage user or customer or receiver to pay by using imTransporter Driver application QR code and discourage to collect cash. In case user or customer or receiver does not have the UPI enable in that case only driver can collect the cash (complete trip amount) remember in this complete amount, government taxes also included hence imTransporter have to debit the taxes from actual pocket balance for respective trip. Independent driver or transportation agency or contractor gets real time trips notification created by customer hence if trips not generated by customers imTransporter do not have any control on customer to generate trips. As imTransporter is providing a service as aggregator platform for driver and customer.

•Also, imTransporter is not responsible and not liable to respond to any allegation or pay any kind of settlement allegation made by Independent driver or transportation agency or contractor because imTransporter does not have full control on delay in notification or any technical glitch such as server delayed response, internet breakdown, hacking, database crash, third party dependency failed or any natural calamities etc

•You warrant, undertake and guarantee to us: Independent driver or transportation agency or contractor that you will keep minimum amount balance in pocket of driver application as per guided by imTransporter application. Keeping minimum balance amount in pocket is essential to get the trips to all Independent driver or transportation agency or contractor. The intention and purpose to keep this balance in pocket is solely for the purpose hereby mentioned : in case customer or user paid the service charges as cash in that case imTransporter can recover the taxes from pocket.

Dangerous Goods / Security

We do not carry, nor perform other Services regarding, goods which are in our sole opinion Dangerous Goods including, but not limited to, those specified in the regulations, guidelines, technical instructions, codes applicable to us and our business or to the transport of, or the performance of other Services regarding, Dangerous Goods.
We may at our discretion accept some Dangerous Goods for carriage, or for the performance of other Services, in some locations if you have been accorded the status of an approved Independent driver or transportation agency or contractor and this must be given by us in writing before your consignment can be accepted.
Prohibited Items: We do not accept consignments that contain prohibited items.
We accept consignments only upon customer declaration of the type and value of the consignment (“said to contain” basis). We have no responsibility whatsoever as to the correctness of description, type or value thereof and you agree to indemnify us and hold us harmless from any claims that may be brought against us arising out of or relating to such declaration provided by customer and any costs we will incur relating thereto.

Rejected Consignments

If the receiver refuses to accept delivery, we will try to contact customer who generated the consignment request and agree to the next action if it is appropriate. Customer agree to pay us any costs we incur in forwarding, disposing of or returning the consignment and our charges (if any) for the agreed appropriate next action. We will keep you posted regarding the same.

Indemnification

Except as otherwise to any breach constituted by any party herein, Parties agree to indemnify, release, and hold harmless the other, its agents, affiliates, officers, and employees from any claims, losses, damage, damages, penalties, obligations, and other expenses of any kind resulting to or arising from any of their act or omission. This indemnification will survive the termination of this Agreement.

Modifications

No amendment or modification to this Agreement shall be presumed to have been made unless such amendment is made in writing and signed by the Parties hereto.

Assignment

Independent driver or Transportation Agency or Contractor may not assign, subcontract, or otherwise transfer to another Independent driver or Transportation Agency or Contractor the duties and responsibilities set forth in this agreement without due prior and written notice to Company.

Relativity

This agreement inures to the benefit of, and is binding upon the successions, executors, heirs, and assigns of the parties hereto.

Severability

In case a competent court or authority holds invalid any of the provisions hereto, such invalidity shall affect only the said provision and the remaining provisions shall remain valid and enforceable.

Claims Brought By Third Parties

You undertake to us that you shall not permit any other person who has an interest in the consignment to bring a claim or action against us arising out of Carriage even though we may have been negligent or in default and if a claim or action is made you will indemnify us against the consequences of the claim or action and the costs and expenses we incur in defending it. The above mentioned terms and conditions of use and/or Agreement and the Privacy Policy constitute the entire agreement between the User(s) and imTransporter with respect to access to and use of the web site and the Services offered by imTransporter application or web portal, superseding any prior written or oral agreements in relation to the same subject matter herein.

Governing Law And Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the India, without regard to the principles of conflict of laws. The courts of [Pune] shall have exclusive jurisdiction over any disputes, differences or claims arising out of or in connection with these Terms of Service or any Services provided by us pursuant to these Terms of Service.

Non-waiver

No act or omission shall be construed as a waiver of any party in their failure to exercise their demandable right over the other's breach of this Agreement. Only by express written consent and duly signed by the waiving party shall be considered as having been made.

Disclaimer

All vehicles registered with the company mobile application are continuously tracked using mobile technology for security reasons only. It is hereby made expressly clear to you that the Company does not own any vehicle nor it directly or indirectly employ any transporter or Independent driver for the vehicles or Labour for loading/unloading of Consignment. Vehicles, Independent drivers and Labour are all supplied by third parties and transporters are on their own and the Company disclaims any and all liability(ies) in respect of the Labour, Independent drivers, transporter, goods, any material or products or documents or liquid or solid or any non-living carried during transport and the vehicles alike.The Company have right to use the Independent driver’s or transportation agency's contact information for its own marketing purposes. The Company may send regular SMS updates to the mobile numbers registered with it.

The information contained in imTransporterdriver Application or imTransporter web portal is for general information purposes only. The information is provided by imTransporter and while we endeavor to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website / App or the information, products, services, or related graphics contained on the website / App for any purpose. Any reliance you place on such information is therefore strictly at your own risk.

In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website / App. Through this website / App you are able to link to other websites which are not under the control of imTransporter. We have no control over the nature, content and availability of those sites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.

Every effort is made to keep the portal up and running smoothly. However, imTransporter takes no responsibility for, and will not be liable for, the portal being temporarily unavailable due to technical issues beyond our control.

Entire Agreement

This Agreement contains the terms and conditions of the entire agreement between the Parties and supersedes the other agreements made prior in relation to the subject matter. No other conditions, representation, warranty, collateral, or any other condition shall affect this Agreement except as expressly provided hereto.

यह स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार ( "समझौता") पहली बार साइनअप के इस दिन निष्पादित किया गया, कानूनी इकाई के तहत पंजीकृत imTransporter ब्रांड नाम द्वारा और के बीच कालिब्रोइडा टेक्नोलॉजी सॉल्यूशंस प्राइवेट लिमिटेड, सूरतवाला में पते के साथ मार्क प्लाज़ो, 808, सर्वे नंबर 27/1,28/1, हिंजवाड़ी इन्फोटेक पार्क, हिंजवाड़ी, फेज 1 पुणे महाराष्ट्र 411057, imTransporter द्वारा प्रतिनिधित्व किया गया (जिसे आगे "कंपनी" या "हम" के रूप में जाना जाता है); और otp पुष्टि के साथ एक ड्राइवर के रूप में imTransporterdriver मोबाइल एप्लिकेशन पर साइन अप किया गया (जिसे आगे "स्वतंत्र चालक" या "परिवहन एजेंसी" या "ठेकेदार" के रूप में जाना जाता है);

सेवाएं

स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार कंपनी द्वारा निर्दिष्ट पिक-अप बिंदुओं से गंतव्य के विशिष्ट बिंदुओं तक डिलीवरी या कैरिज परिवहन के लिए माल परिवहन सेवाएं प्रदान करेगा, जिन्हें कंपनी द्वारा इस समझौते के नियमों और शर्तों के अनुसार आवधिक आधार पर बताया जाएगा।

सेवाओं की शर्तें

स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार इस बात से सहमत है और स्वीकार करता है कि वाहन का उपयोग स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार के एकमात्र जोखिम पर है और आगे यह भी स्वीकार करता है कि imTransporter केवल एक एग्रीगेटर है और किसी भी प्रकार के सभी अभ्यावेदन और वारंटी को अस्वीकार करता है, चाहे वह व्यक्त हो या निहित।

स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार को यह सुनिश्चित करना होगा कि वे सेवा का लाभ उठाते समय निम्नलिखित में से किसी भी गतिविधि में शामिल नहीं होंगे:

परिवहन के दौरान माल को गंदा करना या नुकसान पहुंचाना
किसी भी सामान का दुरुपयोग करना, उसे गंदा करना या क्षति पहुंचाना।
स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार किसी भी उद्देश्य के लिए यातायात/आरटीओ/शहर पुलिस और/या सरकारी नियमों का उल्लंघन नहीं करेगा। यदि कोई ग्राहक ऐसा करने की मांग करता है तो स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार को ऐसे अनुरोध को अस्वीकार करने का अधिकार है। स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार को ऐसे पिक-अप को अस्वीकार करने का भी अधिकार है
स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार यह सुनिश्चित करता है कि ट्रक में अनुमत सीमा से अधिक माल नहीं भरा जाना चाहिए।
कंपनी को किसी भी दूरसंचार कंपनी द्वारा प्रदान की गई स्थान आधारित जानकारी का उपयोग करने के लिए अधिकृत किया जाता है, जब स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार माल को ट्रांसपोर्टर मोबाइल या वेब प्लेटफ़ॉर्म के माध्यम से परिवहन करने के लिए मोबाइल फोन का उपयोग करता है। स्थान आधारित जानकारी का उपयोग केवल ग्राहक के लिए वाहन का पता लगाने की सुविधा और संभावना को बेहतर बनाने के लिए किया जाएगा।
कंपनी अपने समूह की सभी कंपनियों या किसी सरकारी निकाय को लागू कानून या किसी सरकारी निकाय के निर्देश या अनुरोध के अनुसार कंपनी के पास मौजूद स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार के विवरण को किसी भी तरह से प्रकट करने की हकदार होगी, जैसा कि कंपनी अपने पूर्ण विवेक से उचित समझे या ऐसा करना उसके हित में हो। कंपनी किसी भी समय बिना कोई कारण बताए ग्राहक द्वारा की गई वाहन की बुकिंग को समाप्त करने की हकदार होगी। उपयोगकर्ता(ओं) को ऐसी बुकिंग के संबंध में किए गए किसी भी खर्च के लिए ट्रांसपोर्टर को क्षतिपूर्ति करनी होगी।
पारगमन के दौरान खोई हुई वस्तुओं के मामले में स्वतंत्र चालक या परिवहन एजेंसी जिम्मेदार होगी, यह संबंधित स्वतंत्र चालक या परिवहन एजेंसी की जिम्मेदारी है कि वह प्रत्येक उत्पाद या सामान और पैकिंग की जाँच करे और ग्राहक से पुष्टि करे, वाहन में लोड करते समय और वाहन से उतारते समय। कंपनी "सर्वोत्तम प्रयास" के आधार पर वस्तुओं का पता लगाने का प्रयास करेगी, लेकिन नुकसान या क्षति या चोरी या दुरुपयोग के मामले में इसके लिए जिम्मेदार नहीं है। imTransporter सेवाएँ प्रदान करने के उद्देश्य से वाहनों को एकत्रित करता है। किसी भी वस्तु के नुकसान की स्थिति में, उपयोगकर्ता(ओं) को imTransporter को किए जाने वाले भुगतान को रोकने का कोई अधिकार नहीं होगा। इसके अलावा, यदि उपयोगकर्ता से imTransporter को कोई भी भुगतान imTransporter द्वारा अपने संबंधित चालान/विवरण में निर्धारित अवधि के लिए लंबित है, तो imTransporter लागू कानून के अनुसार, सेवाओं के लिए imTransporter को पूर्ण भुगतान किए जाने तक खेप पर विशेष ग्रहणाधिकार का प्रयोग करने का अधिकार सुरक्षित रखता है। इसके अतिरिक्त, उपयोगकर्ता(ओं) को इस अवधि के दौरान खेप की हिरासत के कारण होने वाले किसी भी नुकसान, क्षति या व्यय के लिए imTransporter को क्षतिपूर्ति करने के लिए उत्तरदायी होगा।
सेवाओं या उपयोगकर्ता या ग्राहक के व्यवहार के संबंध में कोई भी शिकायत, कंपनी के वाहनों या सेवाओं का उपयोग करने के 24 घंटे के भीतर लिखित रूप में imTransporter को सूचित की जा सकती है। कंपनी उपयोगकर्ताओं या ग्राहक के किसी भी आचरण के लिए उत्तरदायी नहीं होगी। हालाँकि, कंपनी आपको उन उपयोगकर्ताओं के खिलाफ किसी भी शिकायत के बारे में सूचित करने के लिए प्रोत्साहित करती है, जिन्हें आपने कंपनी की सेवाओं का उपयोग करने के लिए चुना है।
कंपनी किसी भी समय इन नियमों और शर्तों में से किसी एक या सभी को जोड़ने, बदलने या संशोधित करने की हकदार होगी और स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार ऐसे जोड़, बदलाव या संशोधन से तब तक बाध्य होगा जब तक कि ऐसे जोड़, बदलाव या संशोधन को कंपनी के स्वतंत्र चालक या विक्रेता imTransporter मोबाइल एप्लीकेशन या वेब पोर्टल www.imtransporter.com पर उस तारीख को इन नियमों और शर्तों में शामिल नहीं कर दिया जाता जिस दिन कंपनी यह संकेत दे कि ऐसे जोड़, बदलाव या संशोधन प्रभावी होने वाले हैं।
कंपनी के कॉल सेंटर पर की गई सभी कॉल गुणवत्ता और प्रशिक्षण उद्देश्यों के लिए कंपनी द्वारा रिकॉर्ड की जाती हैं। यदि आप हमारी सेवाओं, लागू शुल्क या सेवा की शर्तों के संबंध में कोई प्रश्न सहित हमारे ऐप/वेबसाइट पर कोई प्रश्न पूछते हैं, तो आप इस प्रकार स्पष्ट रूप से हमारी प्रतिक्रियाओं को प्राप्त करने के लिए सहमति देते हैं, चाहे टेलीफोन कॉल या इलेक्ट्रॉनिक मेल के माध्यम से, ऐसी क्वेरी और हमारी सेवाओं के संबंध में सभी संबंधित जानकारी। संदेह को दूर करने के लिए, संबंधित जानकारी में बिना किसी सीमा के कोई भी मार्केटिंग और/या वाणिज्यिक जानकारी शामिल होगी। आप समझते हैं, सहमत हैं और स्वीकार करते हैं कि ऐसी जानकारी किसी भी स्थिति में दूरसंचार अनचाहे वाणिज्यिक संचार विनियम, 2007 के तहत अनचाहे वाणिज्यिक संचार के रूप में योग्य नहीं होगी और/या ऐसी जानकारी के प्रकटीकरण के कारण, हमारे टेलीफोन नंबर दूरसंचार अनचाहे वाणिज्यिक संचार विनियम, 2007 या किसी अन्य लागू कानून के अनुसार 'राष्ट्रीय कॉल न करें रजिस्टर' या 'निजी कॉल न करें रजिस्टर' के तहत पंजीकृत होने के योग्य नहीं होंगे।
एक बार जब स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार ने imTransporter एप्लिकेशन या वेब पोर्टल का उपयोग करके ग्राहक द्वारा उत्पन्न माल परिवहन अनुरोध को स्वीकार कर लिया, तो स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार द्वारा उसी परिवहन अनुरोध को रद्द करने पर INR. 30/- (भारतीय रुपये तीस) का रद्दीकरण शुल्क लगेगा। परिवहन अनुरोध स्वीकार किए जाने के बाद एक दिन में पाँच बुकिंग रद्द करने पर आपका खाता अस्थायी रूप से 48 घंटे के लिए निलंबित हो जाएगा और आपको 48 घंटे में कोई परिवहन अनुरोध प्राप्त नहीं होगा।

यह समझौता स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार और कंपनी के बीच अनन्य नहीं है और बाद में स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार द्वारा प्रदान की गई समान या समान सेवा वाले अन्य सेवा प्रदाताओं को काम पर रख सकता है। समय-समय पर शेड्यूल में बदलाव हो सकता है;

स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार यह सुनिश्चित करेगा कि वाहन हमेशा कंपनी के लिए तय समय के अनुसार तैयार और उपलब्ध रहेगा, और यह भी सुनिश्चित करेगा कि परिवहन के लिए अक्षम किसी भी वाहन में कोई समस्या होने पर कंपनी को पहले से सूचित किया जाएगा।

संविदा अवधि

यह अनुबंध हर बार ड्राइवर द्वारा imtransporterdriver android या ios एप्लीकेशन में लॉग इन करने पर मान्य होगा और हर बार ड्राइवर द्वारा सेवा पूरी होने या सफल डिलीवरी पर लॉग आउट करने पर समाप्त हो जाएगा।

स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार का खर्च

कंपनी स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार के कार्य-संबंधी व्यय का वहन नहीं करेगी

दलाली

यदि स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार इस अनुबंध की शर्तों के अनुसार अपने कर्तव्यों का पालन करने में असमर्थ है, तो स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार तुरंत कंपनी को इस अनुपस्थिति की सूचना देगा और सेवाओं को किसी अन्य वाहक या स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार को सौंप देगा, जिसकी उम्मीदवारी को अधिकृत सेवा प्रदाता के रूप में imTransporter चालक के मोबाइल एप्लिकेशन या वेब पोर्टल पर अनुमोदित करने की आवश्यकता है, जो इस अनुबंध में स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार और कंपनी के साथ समान शर्तों के अधीन है।

प्रतिस्थापन पार्टी द्वारा की गई किसी भी गलती या क्षति के लिए, स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार को किसी भी क्षति, हानि या देरी के लिए उत्तरदायी ठहराया जाएगा।

अनुबंध राशि

पक्ष सहमत हैं कि स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार को imTransporter एप्लिकेशन या वेब पोर्टल द्वारा प्रदान की गई यात्रा के आधार पर करों सहित हर सप्ताह भुगतान की जाने वाली राशि होगी।

स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार जिम्मेदारियाँ

सेवाएँ प्रदान करते समय, स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार को:

उचित लाइसेंस प्राप्त और योग्य पेशेवर ड्राइवर उपलब्ध कराएं जो दिए गए निर्देशों को समझने और उनका पालन करने में सक्षम हों, जो मोबाइल फोन की कार्यक्षमता को अच्छी तरह समझते हों।
उन्हें सौंपे गए प्रत्येक मामले की सभी परिस्थितियों के अनुसार, उनके द्वारा परिवहन किए जाने वाले माल की सुरक्षा और सतर्कता में असाधारण परिश्रम के साथ कार्य करने की जिम्मेदारी;
यह सुनिश्चित करें कि माल की ढुलाई या माल के परिवहन में, चालक हर समय उचित और विनम्र तरीके से पेशेवर रूप से पेश आएंगे और अपना आचरण करेंगे;
माल को किसी भी दावे, ग्रहणाधिकार, भार, शुल्क या परिवहन के दौरान किसी भी हस्तक्षेप से मुक्त रखना;
सेवाओं के निष्पादन के लिए आवश्यक सभी आवश्यक कानूनी और प्रशासनिक दस्तावेज जैसे परमिट और लाइसेंस सुरक्षित रखें।

सुरक्षा विनियमन

स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार को हर समय:

गाड़ी के लिए निर्धारित आवश्यक मानकों का पालन करने में हर समय जिम्मेदार और पेशेवर रहें;
परिवहन के दौरान आवश्यक सावधानी बरतें और हर समय अपनी जिम्मेदारियों को ध्यान में रखें;
कानून, विनियमन या सरकारी प्राधिकरण द्वारा निर्धारित सभी लागू विनियमों का पालन करें;
अपने ड्राइवरों को आवश्यक ज्ञान, प्रशिक्षण और पर्यवेक्षण प्रदान करें ताकि सेवाएँ प्रदान करते समय उन व्यक्तियों के स्वास्थ्य और सुरक्षा को सुनिश्चित किया जा सके;
सुरक्षा या विनियामक कारणों से कार्गो के किसी भी लोड को अस्वीकार करने या संशोधित करने का विवेकाधिकार है। हालाँकि, इस तरह के इनकार को कंपनी को जल्द से जल्द सूचित करना चाहिए।

वारंटी और प्रतिनिधित्व

स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार इस बात का प्रतिनिधित्व और वारंटी देता है कि उसके पास इस अनुबंध की शर्तों और नियमों के अनुसार कंपनी द्वारा अपेक्षित कर्तव्यों और जिम्मेदारियों को निभाने के लिए आवश्यक सभी उपकरण और कार्मिक हैं।

आपके द्वारा लागू कानून का अनुपालन किया गया है.

हमारे नियंत्रण से बाहर की परिस्थितियाँ जैसे (परन्तु इन्हीं तक सीमित नहीं):
आपके कार्य या चूक या तीसरे पक्ष के कार्य जैसे: आप इन नियमों और शर्तों के तहत अपने दायित्वों का उल्लंघन कर रहे हैं (या माल में रुचि का दावा करने वाला कोई अन्य पक्ष आपको उल्लंघन करने के लिए मजबूर कर रहा है)।
माल की सामग्री में कोई भी ऐसी वस्तु शामिल है जो प्रतिबंधित वस्तु / खतरनाक सामान / मूल्यवान वस्तु है, भले ही हमने गलती से माल स्वीकार कर लिया हो या आपने हमें सूचित / घोषित किए बिना स्वेच्छा से माल वितरित किया हो।

गोपनीयता

इस अनुबंध में उल्लिखित गोपनीय जानकारी उपर्युक्त कंपनी से संबंधित किसी भी जानकारी को संदर्भित करेगी किसी भी स्वामित्व वाली जानकारी, व्यक्तिगत, या किसी भी मामले में, ऐसी जानकारी जिसका खुलासा जनता के सामने नहीं किया गया है या जिसे उचित रूप से सामान्य ज्ञान माना जाता है। स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार किसी तीसरे पक्ष को कंपनी से संबंधित कोई भी गोपनीय जानकारी नहीं बताएगा जिसे स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार ने इस अनुबंध के निष्पादन के दौरान या कंपनी द्वारा स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार को विश्वास में प्राप्त किया हो।

बीमा

स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार को अपनी स्वयं की बीमा पॉलिसी प्राप्त करनी होगी और इस अनुबंध की अवधि के दौरान निम्नलिखित बीमा कवरेज बनाए रखना होगा:

सभी जोखिम कार्गो बीमा.
मोटर वाहन देयता बीमा जिसमें बीमा देयता राशि प्रति घटना 1,00,000 रुपये से कम नहीं है, मृत्यु सहित शारीरिक चोट और संपत्ति की क्षति के लिए एकल सीमा, सभी स्वामित्व वाले और गैर-स्वामित्व वाले मोटर वाहनों को कवर करती है;
वाणिज्यिक सामान्य देयता बीमा जिसमें आकस्मिक और आकस्मिक प्रदूषण कवरेज की राशि 2,00,000 रुपये प्रति घटना से कम नहीं होगी, जिसमें कंपनी बीमाधारक और प्रमाणपत्र धारक होगी। इस देयता बीमा में परिसर और संचालन देयता, संविदात्मक देयता, नियोक्ता देयता, मालिक और स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार की सुरक्षात्मक देयता, पारस्परिक देयता या हितों की पृथक्करणीयता देयता, व्यक्तिगत और विज्ञापन चोट देयता, और संपत्ति कवरेज के उपयोग की हानि शामिल होगी। सक्रिय बीमा रखना और बीमा खरीदना पूरी तरह से “स्वतंत्र चालक” या “परिवहन एजेंसी” या “ठेकेदार” की जिम्मेदारी है।

नियोक्ता-कर्मचारी संबंध नहीं

पक्ष सहमत हैं कि यह समझौता नियोक्ता-कर्मचारी संबंध नहीं बनाता है। पक्ष इसी तरह सहमत हैं कि यह समझौता साझेदारी या संयुक्त उद्यम नहीं बनाता है, बल्कि यह विशेष रूप से सेवा के लिए एक अनुबंध है।

कंपनी को स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार के भविष्य निधि या ईएसआईसी या किसी भी कर्मचारी बीमा या सामाजिक सुरक्षा, कर, बेरोजगारी या श्रमिकों के मुआवजे, बीमा प्रीमियम, या कंपनी के रोजगार के तहत व्यक्तियों द्वारा प्राप्त किसी भी अन्य लाभ का भुगतान या योगदान करने की आवश्यकता नहीं है।

आपका दायित्व

•आप हमें वारंट, वचन और गारंटी देते हैं: स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार को यह ध्यान रखना चाहिए कि माल की सामग्री (जिसमें वजन और वस्तुओं की संख्या शामिल है, लेकिन इन्हीं तक सीमित नहीं है) को चालक के मोबाइल एप्लिकेशन पर साझा किए गए माल के नोट पर ठीक से वर्णित किया गया है और स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार की यह जिम्मेदारी है कि माल के नोट में उल्लिखित वस्तुएं/माल और परिवहन के लिए वास्तव में दिए गए सामान/माल एक जैसे हों और माल का नोट सभी तरह से पूरा हो और माल के परिवहन के लिए आवश्यक दस्तावेज जैसे चालान, परमिट आदि माल के नोट के साथ संलग्न किए गए हों।

•कि माल की सामग्री निषिद्ध वस्तुएँ नहीं हैं और/या लागू विनियमों द्वारा प्रतिबंधित नहीं हैं और ग्राहक ने स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार को कोई भी खतरनाक माल घोषणा प्रदान की है जो लागू कानून के अनुसार उचित और सटीक रूप से आवश्यक है और न तो आप और न ही प्राप्तकर्ता ऐसा व्यक्ति या संगठन है जिसके साथ हम या आप लागू कानून के तहत कानूनी रूप से व्यापार नहीं कर सकते हैं।

•आपके द्वारा खेप से संबंधित सभी कथन और जानकारी और दस्तावेज सत्य और सही होंगे और आप स्वीकार करते हैं कि यदि आप खेप या इसकी किसी भी सामग्री के बारे में असत्य या धोखाधड़ी वाला कथन देते हैं, तो आप एक सिविल दावे और/या आपराधिक अभियोजन का जोखिम उठाएंगे, जिसके लिए दंड में जब्ती और बिक्री शामिल हो सकती है। आप हमें क्षतिपूर्ति करने और आपके द्वारा प्रदान की गई जानकारी से उत्पन्न होने वाले किसी भी दावे से हमें हानिरहित रखने के लिए सहमत हैं जो हमारे या हमारे एजेंटों के खिलाफ लाया जा सकता है।

•आप माल को कंसाइनमेंट नोट पर दिए गए पते पर डिलीवर करने के लिए अधिकृत हैं और पूर्वगामी के पक्षपात के बिना यह स्पष्ट रूप से सहमत है कि हम इस अनुबंध के अनुसार माल डिलीवर करने के लिए निर्णायक रूप से मान लिए जाएँगे। हमें ट्रांसपोर्टर के आवेदन पर डिलीवरी के लिए स्वतंत्र चालक या परिवहन एजेंसी से पुष्टि की आवश्यकता है। अपेक्षित डिलीवरी समय के 24 घंटे के भीतर कोई प्रतिक्रिया न मिलने पर नियमों का उल्लंघन माना जाएगा। आपको यह सुनिश्चित करना होगा कि कंसाइनमेंट का वजन सही है।

•आप समझते हैं, सहमत हैं और स्वीकार करते हैं कि सेवाएँ नकदी, सोना, चांदी, हीरा, कीमती पत्थर, जवाहरात या आभूषण, महंगी विलासिता वस्तुएँ आदि ("मूल्यवान वस्तुएं") जैसे मूल्यवान वस्तुओं के परिवहन के लिए उपयुक्त नहीं हैं। यदि आप परिवहन के लिए मूल्यवान वस्तुओं के साथ वाहन सौंपते/लोड करते हैं, तो माल की कोई भी हानि/क्षति/चोरी/दुरुपयोग आपके जोखिम पर होगी, न कि हमारी, पहले बताए गए कारणों से और बिना किसी पूर्वाग्रह के, हमें न केवल माल की क्षति/हानि/चोरी/दुरुपयोग या माल की किसी भी सामग्री से उत्पन्न/उपार्जित किसी भी देयता और/या जिम्मेदारी को स्पष्ट रूप से और विशेष रूप से अस्वीकार करने का अधिकार होगा, बल्कि आपसे क्षतिपूर्ति का दावा करने का अधिकार भी होगा, जहाँ आपकी सेवा की शर्तों का उल्लंघन करने के कारण हमें प्रतिष्ठा/सद्भावना का नुकसान हुआ है।

•आप हमें क्षतिपूर्ति देने और हमें किसी भी देयता से बचाने के लिए सहमत हैं, जो हमें भुगतना पड़ सकता है या किसी भी लागत, क्षति या व्यय, जिसमें कानूनी लागत भी शामिल है, जो हम आपके या किसी अन्य व्यक्ति के लिए उठाते हैं, जो आपके द्वारा इनमें से किसी भी वारंटी, प्रतिनिधित्व और गारंटी के उल्लंघन के कारण उत्पन्न होता है, भले ही हम अनजाने में कोई ऐसी खेप स्वीकार कर लें जो आपके किसी भी दायित्व का उल्लंघन करती हो।

•आप प्रमाणित करते हैं कि आपके द्वारा खेप के परिवहन या वाहन संबंधी सभी कथन और जानकारी या वाहन या स्वतंत्र चालक के सभी आवश्यक वैध दस्तावेज़ सत्य और सही होंगे।

•आप स्वीकार करते हैं कि यदि आप माल या उसकी किसी भी सामग्री के बारे में असत्य या धोखाधड़ीपूर्ण बयान देते हैं, तो आप एक सिविल दावे और/या आपराधिक अभियोजन का जोखिम उठाते हैं, जिसके लिए दंड में जब्ती शामिल है।

•जहाँ तक हम स्वेच्छा से आपको आवश्यक सीमा शुल्क और अन्य औपचारिकताओं को पूरा करने में सहायता कर सकते हैं, ऐसी सहायता आपके एकमात्र जोखिम पर प्रदान की जाएगी। आप हमें क्षतिपूर्ति करने और वाहन और संबंधित स्वतंत्र चालक से संबंधित आपके द्वारा हमें प्रदान की गई जानकारी से उत्पन्न होने वाले किसी भी दावे से हमें हानिरहित रखने के लिए सहमत हैं और इस संबंध में हमें जो भी लागत आएगी, और इस शर्त में वर्णित सेवाएँ प्रदान करने के लिए हम आपसे जो भी प्रशासनिक शुल्क ले सकते हैं, उसका भुगतान करेंगे।

•ग्राहक इस बात से सहमत है और स्वीकार करता है कि कंपनी द्वारा दी जाने वाली सेवाओं का उपयोग ग्राहक के एकमात्र जोखिम पर है और कंपनी किसी भी तरह के सभी अभ्यावेदन और वारंटी को अस्वीकार करती है, चाहे वह स्थिति, उपयुक्तता, गुणवत्ता, व्यापारिकता और किसी भी उद्देश्य के लिए उपयुक्तता के बारे में व्यक्त या निहित हो, लागू कानून द्वारा अनुमत पूरी सीमा तक बहिष्कृत हैं। उपरोक्त के प्रति पूर्वाग्रह के बिना, कंपनी स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार की आवश्यकताओं को पूरा करने वाली सेवाओं के संबंध में कोई अभ्यावेदन या वारंटी नहीं देती है।

•सेवाएँ निर्बाध, समयबद्ध, सुरक्षित या त्रुटि-मुक्त होंगी।

• स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार द्वारा कंपनी द्वारा दी जाने वाली सेवाओं के उपयोग से उत्पन्न किसी भी नुकसान या क्षति के लिए कोई भी जिम्मेदारी या दायित्व, या किसी भी कारण से स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार को सेवाएं प्रदान करने में कंपनी की विफलता के कारण, जिसमें स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार द्वारा सेवाओं के रिकॉर्ड किए गए वॉयस निर्देशों का पालन न करना, खराबी, किसी भी नेटवर्क टर्मिनल, डेटा प्रोसेसिंग सिस्टम, कंप्यूटर टेली-ट्रांसमिशन या दूरसंचार प्रणाली की आंशिक या पूर्ण विफलता या अन्य परिस्थितियाँ शामिल हैं, चाहे वे कंपनी या किसी व्यक्ति या उपर्युक्त प्रणालियों में शामिल किसी संगठन के नियंत्रण से परे हों या नहीं। कंपनी द्वारा दी जाने वाली सेवा के उपयोग से उत्पन्न किसी भी प्रकार के नुकसान के लिए कोई भी दायित्व, जिसमें प्रत्यक्ष, अप्रत्यक्ष, आकस्मिक, दंडात्मक और परिणामी नुकसान शामिल हैं, लेकिन इन्हीं तक सीमित नहीं हैं। दूर के स्थानों के लिए कोई अतिरिक्त या अतिरिक्त शुल्क और टोल शुल्क भी। दूर के स्थानों के लिए कोई अतिरिक्त या अतिरिक्त शुल्क और टोल शुल्क भी।

•आप हमें वारंट, वचन और गारंटी देते हैं: स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार कि आप उपयोगकर्ता या ग्राहक या रिसीवर को imTransporter ड्राइवर एप्लिकेशन QR कोड का उपयोग करके भुगतान करने के लिए प्रोत्साहित करेंगे और नकद इकट्ठा करने से हतोत्साहित करेंगे। यदि उपयोगकर्ता या ग्राहक या रिसीवर के पास UPI सक्षम नहीं है, तो उस स्थिति में केवल ड्राइवर ही नकद (पूरी यात्रा राशि) एकत्र कर सकता है, याद रखें कि इस पूरी राशि में सरकारी कर भी शामिल हैं, इसलिए imTransporter को संबंधित यात्रा के लिए वास्तविक पॉकेट बैलेंस से करों को डेबिट करना होगा। स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार को ग्राहक द्वारा बनाई गई वास्तविक समय की यात्रा अधिसूचना मिलती है, इसलिए यदि ग्राहक द्वारा यात्राएँ उत्पन्न नहीं की जाती हैं, तो imTransporter के पास यात्राएँ उत्पन्न करने के लिए ग्राहक पर कोई नियंत्रण नहीं है। चूंकि imTransporter ड्राइवर और ग्राहक के लिए एग्रीगेटर प्लेटफ़ॉर्म के रूप में सेवा प्रदान कर रहा है।

•इसके अलावा, imTransporter किसी भी आरोप का जवाब देने या स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार द्वारा लगाए गए किसी भी तरह के निपटान के आरोप का भुगतान करने के लिए जिम्मेदार नहीं है क्योंकि imTransporter के पास अधिसूचना में देरी या किसी भी तकनीकी गड़बड़ी जैसे सर्वर देरी से प्रतिक्रिया, इंटरनेट ब्रेकडाउन, हैकिंग, डेटाबेस क्रैश, तीसरे पक्ष की निर्भरता विफल या किसी भी प्राकृतिक आपदा आदि पर पूर्ण नियंत्रण नहीं है।

•आप हमें वारंट, वचन और गारंटी देते हैं: स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार कि आप imTransporter आवेदन के अनुसार चालक आवेदन की जेब में न्यूनतम राशि शेष रखेंगे। सभी स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार को यात्राएं करवाने के लिए जेब में न्यूनतम राशि रखना आवश्यक है। इस राशि को जेब में रखने का इरादा और उद्देश्य केवल इस उद्देश्य के लिए है: यदि ग्राहक या उपयोगकर्ता ने सेवा शुल्क नकद में भुगतान किया है, तो उस स्थिति में imTransporter जेब से कर वसूल सकता है।

खतरनाक सामान / सुरक्षा

हम ऐसे माल का परिवहन नहीं करते हैं, न ही उनसे संबंधित अन्य सेवाएँ प्रदान करते हैं, जो हमारे एकमात्र विचार में खतरनाक माल हैं, जिनमें हमारे और हमारे व्यवसाय पर लागू विनियमों, दिशा-निर्देशों, तकनीकी निर्देशों, संहिताओं में निर्दिष्ट खतरनाक माल शामिल हैं, लेकिन इन्हीं तक सीमित नहीं हैं, या खतरनाक माल के परिवहन या उससे संबंधित अन्य सेवाओं के प्रदर्शन के लिए लागू हैं।
हम अपने विवेक से कुछ स्थानों पर परिवहन के लिए या अन्य सेवाओं के प्रदर्शन के लिए कुछ खतरनाक सामान स्वीकार कर सकते हैं, यदि आपको एक अनुमोदित स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार का दर्जा दिया गया है और आपके माल को स्वीकार किए जाने से पहले हमें यह लिखित रूप में देना होगा।
निषिद्ध वस्तुएँ: हम ऐसी खेप स्वीकार नहीं करते हैं जिसमें निषिद्ध वस्तुएँ हों।
हम केवल ग्राहक द्वारा माल के प्रकार और मूल्य की घोषणा के आधार पर माल स्वीकार करते हैं ("कहा जाता है कि इसमें माल शामिल है")। विवरण, प्रकार या मूल्य की शुद्धता के बारे में हमारी कोई जिम्मेदारी नहीं है और आप हमें क्षतिपूर्ति करने और ग्राहक द्वारा प्रदान की गई ऐसी घोषणा से उत्पन्न होने वाले या उससे संबंधित किसी भी दावे और उससे संबंधित किसी भी लागत के लिए हमें हानिरहित रखने के लिए सहमत हैं।

अस्वीकृत माल

यदि प्राप्तकर्ता डिलीवरी स्वीकार करने से इनकार करता है, तो हम उस ग्राहक से संपर्क करने का प्रयास करेंगे जिसने खेप का अनुरोध किया था और यदि उचित हो तो अगली कार्रवाई के लिए सहमत होंगे। ग्राहक हमें खेप को अग्रेषित करने, निपटाने या वापस करने में होने वाली किसी भी लागत और सहमत उचित अगली कार्रवाई के लिए हमारे शुल्क (यदि कोई हो) का भुगतान करने के लिए सहमत हैं। हम आपको इसके बारे में सूचित करते रहेंगे।

प्रीमियम

किसी भी पक्ष द्वारा किए गए उल्लंघन के अलावा, पक्ष दूसरे पक्ष, उसके एजेंटों, सहयोगियों, अधिकारियों और कर्मचारियों को किसी भी तरह के दावों, हानि, क्षति, क्षति, दंड, दायित्वों और अन्य खर्चों से क्षतिपूर्ति, रिहाई और हानिरहित रखने के लिए सहमत हैं, जो उनके किसी भी कार्य या चूक के परिणामस्वरूप या उससे उत्पन्न होते हैं। यह क्षतिपूर्ति इस अनुबंध की समाप्ति के बाद भी जारी रहेगी।

संशोधनों

इस समझौते में कोई संशोधन या परिवर्तन तब तक नहीं माना जाएगा जब तक कि ऐसा संशोधन लिखित रूप में न किया जाए और पक्षकारों द्वारा हस्ताक्षरित न किया जाए।

कार्यभार

स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार कंपनी को पूर्व और लिखित सूचना दिए बिना इस अनुबंध में निर्धारित कर्तव्यों और जिम्मेदारियों को किसी अन्य स्वतंत्र चालक या परिवहन एजेंसी या ठेकेदार को नहीं सौंप सकते, उप-अनुबंध नहीं कर सकते या अन्यथा हस्तांतरित नहीं कर सकते।

सापेक्षता

यह समझौता पक्षकारों के उत्तराधिकारियों, निष्पादकों, वारिसों और समनुदेशितियों के लाभ के लिए है और उन पर बाध्यकारी है।

विच्छेदनीयता

यदि कोई सक्षम न्यायालय या प्राधिकारी किसी भी प्रावधान को अवैध ठहराता है, तो ऐसी अवैधता केवल उक्त प्रावधान को प्रभावित करेगी और शेष प्रावधान वैध और लागू रहेंगे।

तीसरे पक्ष द्वारा लाए गए दावे

आप हमें वचन देते हैं कि आप किसी अन्य व्यक्ति को, जिसका माल में हित है, हमारे विरुद्ध परिवहन से संबंधित कोई दावा या कार्रवाई करने की अनुमति नहीं देंगे, भले ही हम लापरवाह या चूककर्ता रहे हों और यदि कोई दावा या कार्रवाई की जाती है तो आप दावे या कार्रवाई के परिणामों और उसे बचाने में हमें होने वाली लागतों और व्ययों के विरुद्ध क्षतिपूर्ति करेंगे। उपयोग और/या अनुबंध की उपर्युक्त शर्तें और गोपनीयता नीति, उपयोगकर्ता(ओं) और imTransporter के बीच वेब साइट और imTransporter एप्लिकेशन या वेब पोर्टल द्वारा प्रदान की जाने वाली सेवाओं तक पहुँच और उपयोग के संबंध में संपूर्ण अनुबंध का गठन करती है, जो यहाँ समान विषय-वस्तु के संबंध में किसी भी पूर्व लिखित या मौखिक अनुबंध का स्थान लेती है।

शासन कानून और अधिकार क्षेत्र

ये सेवा शर्तें भारत के कानूनों के अनुसार संचालित और व्याख्या की जाएंगी, कानूनों के टकराव के सिद्धांतों की परवाह किए बिना। [पुणे] की अदालतों के पास इन सेवा शर्तों या इन सेवा शर्तों के अनुसार हमारे द्वारा प्रदान की गई किसी भी सेवा से उत्पन्न या उससे संबंधित किसी भी विवाद, मतभेद या दावे पर विशेष अधिकार क्षेत्र होगा।

गैर-छूट

किसी भी कार्य या चूक को किसी भी पक्ष द्वारा दूसरे पक्ष द्वारा इस समझौते के उल्लंघन पर अपने मांगे जाने योग्य अधिकार का प्रयोग करने में विफलता के रूप में नहीं समझा जाएगा। केवल लिखित सहमति और विधिवत हस्ताक्षरित छूट पक्ष द्वारा ही छूट दी गई मानी जाएगी।

अस्वीकरण

कंपनी के मोबाइल एप्लीकेशन में पंजीकृत सभी वाहनों को सुरक्षा कारणों से मोबाइल तकनीक का उपयोग करके लगातार ट्रैक किया जाता है। आपको यह स्पष्ट रूप से स्पष्ट किया जाता है कि कंपनी के पास कोई वाहन नहीं है और न ही यह प्रत्यक्ष या अप्रत्यक्ष रूप से माल की लोडिंग/अनलोडिंग के लिए किसी ट्रांसपोर्टर या स्वतंत्र चालक या श्रमिक को नियुक्त करती है। वाहन, स्वतंत्र चालक और श्रमिक सभी तीसरे पक्ष द्वारा आपूर्ति किए जाते हैं और ट्रांसपोर्टर स्वयं के होते हैं और कंपनी परिवहन के दौरान ले जाए गए श्रमिक, स्वतंत्र चालक, ट्रांसपोर्टर, माल, किसी भी सामग्री या उत्पाद या दस्तावेज या तरल या ठोस या किसी भी निर्जीव वस्तु और वाहनों के संबंध में किसी भी और सभी देयताओं को अस्वीकार करती है। कंपनी को अपने स्वयं के विपणन उद्देश्यों के लिए स्वतंत्र चालक या परिवहन एजेंसी की संपर्क जानकारी का उपयोग करने का अधिकार है। कंपनी अपने साथ पंजीकृत मोबाइल नंबरों पर नियमित एसएमएस अपडेट भेज सकती है।

imTransporterdriver एप्लीकेशन या imTransporter वेब पोर्टल में निहित जानकारी केवल सामान्य सूचना उद्देश्यों के लिए है। यह जानकारी imTransporter द्वारा प्रदान की जाती है और यद्यपि हम जानकारी को अद्यतित और सही रखने का प्रयास करते हैं, हम वेबसाइट/ऐप या वेबसाइट/ऐप पर मौजूद जानकारी, उत्पादों, सेवाओं या संबंधित ग्राफिक्स के संबंध में पूर्णता, सटीकता, विश्वसनीयता, उपयुक्तता या उपलब्धता के बारे में किसी भी प्रकार का कोई प्रतिनिधित्व या वारंटी नहीं देते हैं। इसलिए ऐसी जानकारी पर आपका कोई भी भरोसा पूरी तरह से आपके अपने जोखिम पर है।

किसी भी स्थिति में हम किसी भी नुकसान या क्षति के लिए उत्तरदायी नहीं होंगे, जिसमें बिना किसी सीमा के, अप्रत्यक्ष या परिणामी नुकसान या क्षति, या इस वेबसाइट / ऐप के उपयोग से उत्पन्न होने वाले डेटा या लाभ के नुकसान से उत्पन्न होने वाली कोई भी हानि या क्षति शामिल है। इस वेबसाइट / ऐप के माध्यम से आप अन्य वेबसाइटों से लिंक करने में सक्षम हैं जो imTransporter के नियंत्रण में नहीं हैं। उन साइटों की प्रकृति, सामग्री और उपलब्धता पर हमारा कोई नियंत्रण नहीं है। किसी भी लिंक को शामिल करने का मतलब यह नहीं है कि हम उनमें व्यक्त विचारों की अनुशंसा या समर्थन करते हैं।

पोर्टल को सुचारू रूप से चालू रखने के लिए हर संभव प्रयास किया जाता है। हालाँकि, imTransporter हमारे नियंत्रण से परे तकनीकी समस्याओं के कारण पोर्टल के अस्थायी रूप से अनुपलब्ध होने की कोई जिम्मेदारी नहीं लेता है और इसके लिए उत्तरदायी नहीं होगा।

पूरे समझौते

इस अनुबंध में पक्षों के बीच संपूर्ण अनुबंध की शर्तें और नियम शामिल हैं और यह विषय-वस्तु के संबंध में पहले किए गए अन्य अनुबंधों का स्थान लेता है। कोई अन्य शर्तें, प्रतिनिधित्व, वारंटी, संपार्श्विक या कोई अन्य शर्त इस अनुबंध को प्रभावित नहीं करेगी, सिवाय इसके कि इसमें स्पष्ट रूप से प्रावधान किया गया हो।
